Invitation to the webinar: Asset freezes by the Oldenburg public prosecutor’s office at the Lichtmiete companies – What you should do now! On March 3, 2022, the Oldenburg Public Prosecutor’s Office imposed asset freezes on the assets of numerous Deutsche Lichtmiete companies and requested all investors in the companies concerned to report to the Oldenburg Public Prosecutor’s Office under file number 11B AR 100359/21 as so-called offenders and to state whether and in what amount they are claiming compensation. The purchasers of the participation certificates of Deutsche Lichtmiete were requested to file a separate claim under file number 11B AR 100641/21 (SH Tatverletzte). The background to the asset freezes is the suspicion of the Oldenburg Public Prosecutor’s Office that the defendants deliberately made, or caused to be made, misleading statements in the prospectuses for the following bond issues in order to attract investor funds in this way and to secure the economic continued existence of the Deutsche Lichtmiete group of companies as well as their own income from their activities there, while fulfillment of the repayment obligations was not to be expected due to the earnings situation of the group of companies: Insofar as assets have been secured at companies other than the above-mentioned issuers of the bonds, the security measures are based on the shifting of the proceeds and/or the value of the proceeds to these companies. For this purpose, please refer to https://staatsanwaltschaft-oldenburg.niedersachsen.de/startseite/aktuelles/sonderveroffentlichung_presse/anspruchsanmeldungen-im-ermittlungskomplex-deutsche-lichtmiete-unternehmensgruppe-deutschland-und-lichtmiete-holding-ag-schweiz-209029.html for the form provided by the Public Prosecutor’s Office for filing claims. Susanne Schmidt-Morsbach, Partnerin with Schirp & partner attorneys mbB in Berlin: We recommend all investors to announce your demands with the public prosecutor’s office in time-keeping. After the board of Lichtmiete AG surprisingly withdrew its own applications for the opening of insolvency proceedings, a filing makes sense from our point of view.” Stefan Loipfinger, analyst from Rosenheim: “I fear that we will be dealing with P&R 2.0 here. It was unfortunately foreseeable that something was wrong at Lichtmiete.” We recommend you as an investor to follow the request of the public prosecutor’s office and to send the completed form by e-mail or mail to the public prosecutor’s office by April 4, 2022 at the latest. The law firm Schirp & Partner Rechtsanwälte mbB offers affected investors a free and non-binding information event on this topic: On March 16, 2022 in the time from 7:00 p.m. to 8:00 p.m., we invite all investors to a webinar on questions regarding the filing of claims and all background information at Deutsche Lichtmiete.
